What Form 8 is for

An enduring power of attorney must be in an approved form, and an advance health directive may be (s 44(1)-(2), Powers of Attorney Act 1998 (Qld)). The chief executive approves the forms under section 161, and Form 8, Version 1, approved for use from 30 November 2020, is the approved additional page. The enduring power of attorney and advance health directive forms tell you to attach extra pages when you run out of space, for example to appoint more attorneys or add terms and instructions, and to tick the box showing extra pages are attached. Each additional page identifies the document it belongs to and the principal, is numbered, and is signed by the principal (or the person signing for them) and the witness, so it is clearly part of the document that was witnessed.

When you need it

  • You are making an enduring power of attorney (Form 2 short form or Form 3 long form) and need more room, for example to appoint more than four attorneys for a matter type, or to write longer terms, instructions or views, wishes and preferences.
  • You are making an advance health directive (Form 4) and need more room for your directions or other information.
  • Not for changing a document that has already been signed and witnessed. To change it, make a new document or revoke the old one.

How to fill it in

  1. 1

    Tick the document type

Tick whether the page is being added to an enduring power of attorney or an advance health directive.

  2. 2

    Name the principal

Insert the full name of the principal, the person making the document, exactly as it appears in the main form.

  3. 3

    Number the page

Complete 'Page __ of __ additional page(s)' on each additional page, so it is clear how many pages were attached.

  4. 4

    Write the additional content

Say which section of the main form the content continues (for example section 3, attorneys for financial matters) and write it clearly. Cross out unused space.

  5. 5

    Sign with the witness

The principal (or the eligible person signing for them) and the witness each sign and date the page, and the witness prints their name. Sign the additional pages when the main document is signed and witnessed, so it is clear they formed part of it.

Filing, lodging and service

  • Form 8 is not lodged anywhere. Attach the completed pages to the original enduring power of attorney or advance health directive and keep it with the original.
  • In the main form, tick the box showing extra pages are attached. The witness certificate on the enduring power of attorney asks the witness to state how many pages the document has, including any additional pages.
  • When you give certified copies to attorneys, doctors or a bank, copy and certify the additional pages too. A copy must be certified as a true and complete copy of the original (s 45).

Common mistakes

  • Keep additional pages to what does not fit. Long, complex instructions can be hard for attorneys and third parties to apply.
  • Use the same name for the principal on every page, and make sure the page numbering matches the page count in the witness certificate.
  • Forms and explanatory guides are published at www.qld.gov.au/guardianship-planahead, as noted on the form.

Frequently Asked Questions

Who signs an additional page for an enduring power of attorney in Queensland?

The principal, or the eligible person signing at the principal's direction, and the witness. Each signs and dates the Form 8 page, and the witness also prints their name.

Can I add pages after my enduring power of attorney is signed?

Form 8 pages are signed by the principal and the witness, and the witness certificate on an enduring power of attorney counts them in the document's pages, so they belong with the document when it is witnessed. To change a completed document, make a new one or revoke the existing one. A later enduring document revokes an earlier one to the extent of any inconsistency (s 50).
