What Form D2.7 is for

Section 92B of the Duties Act 2001 (Qld) gives a first home vacant land concession, and s 95 requires the application to be made in the approved form. Form D2.7 (version 16, effective August 2026) is that form. Its guide says you must be a natural person aged at least 18 (unless QRO grants an exception), not acting as trustee except in limited cases, have never held an interest in a residence anywhere or had this concession before, and build a residence on the land and occupy it as your home within 2 years of the transfer date. For transactions entered into on or after 1 May 2025 there is no cap on land value, but the concession applies only to the residential vacant land and you must pay market value. Before 1 May 2025 the land had to be valued under $500,000. For transactions entered into on or after 1 August 2026 you must have been an Australian citizen, permanent resident or specified foreign retiree.

When you need it

  • You are buying vacant land in Queensland (no building or part of a building on it when acquired) to build a house that will be your first home.
  • At least one buyer qualifies; each buyer can claim on their own share.
  • Use Form D2.1 instead if you are buying an existing or new home.

How to fill it in

  1. 1

    Part A - transaction details

Give the land's address and real property description, the document date (normally the contract date) and transfer date (normally settlement), whether any seller is related to any buyer, and the dutiable value. For transactions on or after 1 May 2025, say whether all the land will be used for residential purposes and, if not, the dutiable value of the residential vacant land portion. For earlier transactions the form says not to continue if the value is $500,000 or more.

  2. 2

    Parts B and C - sellers

Enter each transferor's individual or entity details, any trust name, whether they are a non-Australian entity (they then complete an identity details annexure) and contact details.

  3. 3

    Parts D and E - buyers

Enter each transferee's details, whether they claim the concession, the 1 August 2026 citizenship question, interest held before and after as fractions, the non-Australian entity question and the AFAD questions, with the value of land to be used for residential purposes where AFAD applies.

  4. 4

    Part F - notification obligations

Read the events that require a Notice for reassessment (Form D2.4) within 28 days, such as not finishing the house, or not occupying it, within 2 years of the transfer date, or changing the portion of land used for residential purposes after building.

  5. 5

    Part G - declaration

Each transferee claiming the concession signs before a witness who is not a transferee, a transferee's spouse or related to a transferee.

Filing, lodging and service

  • Give the completed form and transaction documents to your legal adviser, settlement or lodging agent if you have one.
  • Otherwise send them to the Commissioner of State Revenue, GPO Box 2593, Brisbane Qld 4001; you will be notified by email or text when received. QRO's lodging page also accepts scanned documents by email to duties@treasury.qld.gov.au.
  • Transfer duty documents must generally be lodged within 30 days of being signed (QRO). Form D2.7 is lodged instead of Form D2.2.

Common mistakes

  • The 2-year period to build and move in runs from the transfer date of the land, and QRO says it cannot be extended.
  • After the house is built, the residential vacant land you claimed on must keep being used solely for residential purposes.
  • Provide independent evidence of value if you pay less than market value or buy from a relative or associated entity.

Frequently Asked Questions

Is there a value limit on the Queensland first home vacant land concession?

Not for eligible transactions entered into on or after 1 May 2025, though it applies only to the residential vacant land and you must pay market value. For transactions before 1 May 2025 the land had to be valued under $500,000.

What happens if I do not build within 2 years?

You must lodge Form D2.4 within 28 days so QRO can reassess the duty. Failing to notify is an offence and penalty tax and interest may apply.
