What the Certificate Application Form is for
This is Bayside Council's single application form for the property certificates most often needed on a sale. Planning certificates are issued by the council under section 10.7 of the Environmental Planning and Assessment Act 1979. A section 10.7(2) certificate contains the matters prescribed by Schedule 2 of the Environmental Planning and Assessment Regulation 2021: zoning, the planning instruments and policies that apply, planning controls, and hazards and risks. A section 10.7(5) certificate adds any other relevant information the council holds about the land; councils include that advice voluntarily and the Regulation cannot prescribe it. Anyone can buy a planning certificate, for any purpose. Section 603 of the Local Government Act 1993 lets a council issue a certificate stating the amount (if any) of rates, charges and other amounts due or payable to the council for a parcel of land. Section 603(2) requires the application to be accompanied by the approved fee, which the Office of Local Government sets each year; councils may charge a separate fee for expedited processing. The form also offers a section 735A certificate under the Local Government Act 1993, which reports whether the council has outstanding notices on the land, and a copy of a section 10.7 certificate you bought earlier.
When you need it
- You are preparing a contract for the sale of land in the Bayside area and need the section 10.7(2) planning certificate that must be attached to it.
- You act for a buyer or seller and need a section 603 certificate showing rates and charges owing to the council for settlement.
- You want to know whether the council has issued notices on the property that are still outstanding (section 735A).
- You need another copy of a section 10.7 certificate you previously purchased.
How to fill it in
- 1
Tick the certificate and the speed
Choose a section 10.7(2) certificate, a combined 10.7(2) and (5) certificate, a section 603 certificate, a section 735A certificate or a copy of an earlier 10.7 certificate. For each, tick Standard or Urgent. The form gives standard times of 5 working days (planning certificates) and 3 working days (section 603), and urgent times of 48 working hours (planning) or 24 working hours (603 and 735A), and says the planning certificate times are a guide only.
- 2
Applicant details
Give your title, name, mailing address, email and daytime and mobile numbers. If your mailing address differs from your street address, tick Yes and complete the second address block.
- 3
Land details (mandatory)
Enter the property address, lot number(s), section and DP or SP number, and the owner's name. Take the lot and plan numbers from a current title search so the certificate issues for the right land.
- 4
Collection details (mandatory)
Tick whether the certificate is to be emailed (give the address), posted, or collected, in which case give a phone number and contact name.
- 5
Sign the declaration
Sign and date to confirm the information is true and correct. The form warns that an incomplete application may be delayed or rejected and that more information may be requested after lodgement.
Filing, lodging and service
- Lodge online through the council's website (www.bayside.nsw.gov.au), in person at the Rockdale Customer Service Centre (444-446 Princes Highway, Rockdale) or the Eastgardens Customer Service Centre (Westfield Eastgardens, 152 Bunnerong Road, Eastgardens), or by post to Bayside Council, 444-446 Princes Highway, Rockdale NSW 2216.
- The form says payment is preferred by cheque, money order, or debit or credit card (Amex, Visa or Mastercard), and that credit card payments attract a service fee.
- A fee applies to each certificate and the council publishes its current amounts each financial year. Check the current fee schedule before paying, as printed amounts change on 1 July.
- Enquiries: council@bayside.nsw.gov.au or 1300 581 299.
Common mistakes
- Order the 10.7(2) and (5) certificate if the buyer wants the council's extra advice about the land; the contract only needs the 10.7(2) certificate.
- Allow for the standard turnaround before exchange, or pay the urgent fee if the contract has to go out quickly.
- If you only need another copy of a certificate you already bought, tick the copy option rather than paying for a new certificate.
Frequently Asked Questions
What is the difference between a 10.7(2) and a 10.7(2) and (5) planning certificate?

The form gives 3 working days for a standard request and 24 working hours if you pay the urgent fee.
Can I apply for a Bayside Council certificate online?
Yes. The form says you can lodge online through the council website, as well as in person or by post.
