What the Application for Certificates is for

Edward River Council, based in Deniliquin, uses one fillable form for certificates under the Environmental Planning and Assessment Act 1979, the Swimming Pools Act 1992 and the Local Government Act 1993. Planning certificates are issued by the council under section 10.7 of the Environmental Planning and Assessment Act 1979. A section 10.7(2) certificate contains the matters prescribed by Schedule 2 of the Environmental Planning and Assessment Regulation 2021: zoning, the planning instruments and policies that apply, planning controls, and hazards and risks. A section 10.7(5) certificate adds any other relevant information the council holds about the land; councils include that advice voluntarily and the Regulation cannot prescribe it. Anyone can buy a planning certificate, for any purpose. Section 603 of the Local Government Act 1993 lets a council issue a certificate stating the amount (if any) of rates, charges and other amounts due or payable to the council for a parcel of land. Section 603(2) requires the application to be accompanied by the approved fee, which the Office of Local Government sets each year; councils may charge a separate fee for expedited processing. The form also offers an outstanding notices certificate under section 735A, development approval information, a property card, a copy of a building certificate, a water read, a sewer drainage diagram and a swimming pool compliance certificate.

When you need it

  • You are preparing a contract for the sale of land in the Edward River area and need the planning certificate and sewer drainage diagram.
  • You act for a purchaser and need the rates certificate, a final water read and an outstanding notices search.
  • You are selling a property with a pool and need the council's swimming pool compliance certificate.

How to fill it in

  1. 1

    Type of certificate required

Tick each item. A 10.7(5) certificate can only be applied for together with a 10.7(2). If the land is vacant no sewer drainage diagram will exist, and the council supplies a plan of sewer main details instead. Tick urgent request processing if needed (extra fee).

  2. 2

    How the certificate is issued

Choose post, hold for collection, phone, fax or email, and give the fax number or email address.

  3. 3

    Method of payment

Tick cash, cheque or card. A small surcharge applies to credit card payments.

  4. 4

    Applicant's details

Name, company, postal address, suburb, state and postcode, phone, mobile, fax, email and your reference. Sign and date.

  5. 5

    Owner's and property details

Owner's name, postal address and phone; then the unit or house number, street, suburb or town, the assessment number if known, and the lot and DP or SP.

Filing, lodging and service

  • All applications are lodged with Edward River Council, 180 Cressy Street, Deniliquin NSW 2710. Email council@edwardriver.nsw.gov.au or phone 03 5898 3000.
  • A fee applies to each certificate and the council publishes its current amounts each financial year. Check the current fee schedule before paying, as printed amounts change on 1 July.
  • Planning certificates can also be requested through the NSW Planning Portal in participating council areas; the application is sent to the council to review. Check whether this council accepts Planning Portal applications before choosing that route.

Common mistakes

  • Order the 10.7(2) and (5) together if you want the council's extra advice; the (5) cannot be ordered on its own.
  • For vacant land, expect a sewer main plan rather than a house drainage diagram.

Frequently Asked Questions

Can I get a 10.7(5) certificate on its own from Edward River Council?

No. The form says a 10.7(5) application may only be made together with an application for a 10.7(2) certificate.

What if the land is vacant and I need a sewer drainage diagram?

The form says no diagram will exist for vacant land, so the council supplies a plan of sewer main details instead.
