What the Planning Certificate, GIS Sewer Diagram and Section 88G Application Form is for
Planning certificates are issued by the council under section 10.7 of the Environmental Planning and Assessment Act 1979. A section 10.7(2) certificate contains the matters prescribed by Schedule 2 of the Environmental Planning and Assessment Regulation 2021: zoning, the planning instruments and policies that apply, planning controls, and hazards and risks. A section 10.7(5) certificate adds any other relevant information the council holds about the land; councils include that advice voluntarily and the Regulation cannot prescribe it. Anyone can buy a planning certificate, for any purpose. The same form orders a GIS sewer main diagram, with or without aerial mapping, and a certificate under section 88G of the Conveyancing Act 1919. A section 88G certificate states any amount owed to the council for work it has carried out because an owner did not comply with a positive covenant on the land; if unpaid, that debt can pass to a purchaser. Goulburn requires a copy of the section 88B instrument with an 88G application.
When you need it
- You are preparing a contract for the sale of land in the Goulburn Mulwaree area and need the planning certificate and sewer diagram.
- The title has a positive covenant in favour of the council (for example for on-site stormwater) and you need to know if anything is owed.
