What the Application for Planning Certificate (Section 10.7) is for
A planning certificate under section 10.7 of the Environmental Planning and Assessment Act 1979 (NSW), formerly called a section 149 certificate, is issued by the local council and sets out the planning controls that apply to a parcel of land. A section 10.7(2) certificate shows the zoning, the state, regional and local planning controls, and constraints such as land contamination, flooding and bush fire prone land. A section 10.7(2) and (5) certificate adds advice from other authorities and other information the council holds about the land. Kiama Council's 2026/2027 form lets you order a 10.7(2) certificate or a combined 10.7(2) and (5) certificate, and add an urgency fee for faster processing. The council says a 10.7(5) certificate can only be bought together with a 10.7(2) certificate.
When you need it
- You are selling land in the Kiama local government area and need the planning certificate that must be attached to the contract for sale.
- You are buying and want the fuller 10.7(2) and (5) certificate before you commit.
- You want to know the zoning and planning constraints on a property before planning development.
How to fill it in
- 1
Choose the certificate
Tick a 10.7(2) certificate or a 10.7(2) and (5) certificate. Both are listed with a 3-5 business day turnaround. Tick the urgency fee as well if you need it within 24 hours; it is charged on top of the certificate fee.
- 2
Applicant details
Give your name, phone, postal address and postcode, email and any file reference. The certificate and any questions go to this contact.
- 3
Property details
Enter the lot, section (if any) and DP or SP number, and the house number, street and suburb. The lot and plan numbers are on the rates notice or title search.
- 4
Payment details
Name a contact person and phone number for payment. The form says credit card payments (Mastercard or Visa only) are taken by the council calling you, cheques are payable to Kiama Council, and cash is accepted only over the counter.
Filing, lodging and service
- The form can be filled in on screen. The SUBMIT button sends it through a desktop email program such as Outlook; with webmail, save the completed form and email it to council@kiama.nsw.gov.au.
- You can also post it with a cheque or money order, or lodge it at the council office at 11 Manning Street, Kiama.
- A customer service officer checks the form is complete and contacts you for payment. The council says standard processing is 3-5 business days from payment, and the urgency option is 24 hours from payment (one business day).
- A fee applies for each certificate, plus the urgency fee if chosen: check the current amounts with the council.
Common mistakes
- Kiama Council takes section 603 rates certificates through its online self-service portal, not this form. Apply for those separately.
- Outstanding notices and orders certificates (section 735A and Schedule 5) are separate again, and the council says there is no urgency option for them.
Frequently Asked Questions
What is the difference between a 10.7(2) and a 10.7(2) and (5) planning certificate?
A 10.7(2) certificate gives the prescribed planning information: zoning, the planning controls that apply, and constraints such as contamination, flooding and bush fire prone land. A 10.7(2) and (5) certificate includes all of that plus advice from other authorities and other information the council holds about the land.
Do I need a planning certificate to sell a property in NSW?
Yes. The NSW Government's selling guide says the contract for sale must contain a current section 10.7 zoning certificate issued by the local council, along with the title documents and a drainage diagram. The guide also says the contract must be prepared before the property is advertised for sale, so order the certificate early.
How long does a Kiama planning certificate take?
The council's standard time is 3-5 business days from payment. If you pay the additional urgency fee, it aims to issue the certificate within 24 hours of payment (one business day).
