What the Planning Certificate Application is for

A planning certificate under section 10.7 of the Environmental Planning and Assessment Act 1979 (NSW), formerly called a section 149 certificate, is issued by the local council and sets out the planning controls that apply to a parcel of land. A section 10.7(2) certificate shows the zoning, the state, regional and local planning controls, and constraints such as land contamination, flooding and bush fire prone land. A section 10.7(2) and (5) certificate adds advice from other authorities and other information the council holds about the land. Muswellbrook's form is made under sections 8.25 and 10.7 and Schedule 5 of the EP&A Act. It also orders a site sewerage drainage diagram and a certificate of outstanding notices (section 735A of the Local Government Act 1993 and Schedule 5 of the EP&A Act). The NSW Government's selling guide lists a current section 10.7 zoning certificate issued by the local council and a drainage diagram among the documents a contract for the sale of land must contain. If a required disclosure document is not attached, the purchaser may be entitled to rescind within 14 days of exchange, unless settlement has already happened.

Frequently Asked Questions

What is the difference between a 10.7(2) and a 10.7(2) and (5) planning certificate?

A 10.7(2) certificate gives the prescribed planning information: zoning, the planning controls that apply, and constraints such as contamination, flooding and bush fire prone land. A 10.7(2) and (5) certificate includes all of that plus advice from other authorities and other information the council holds about the land.

Do I need a planning certificate to sell a property in NSW?

Yes. The NSW Government's selling guide says the contract for sale must contain a current section 10.7 zoning certificate issued by the local council, along with the title documents and a drainage diagram. The guide also says the contract must be prepared before the property is advertised for sale, so order the certificate early.

Why is a drainage diagram needed when selling?

The NSW Government's selling guide lists a drainage diagram among the documents that must be in a contract for the sale of land, so it is ordered from the council when the contract is being prepared. The guide says the contract must be prepared before the property is advertised for sale.
