What the 10.7 Planning Certificate Application is for

A planning certificate under section 10.7 of the Environmental Planning and Assessment Act 1979 (NSW), formerly called a section 149 certificate, is issued by the local council and sets out the planning controls that apply to a parcel of land. A section 10.7(2) certificate shows the zoning, the state, regional and local planning controls, and constraints such as land contamination, flooding and bush fire prone land. A section 10.7(2) and (5) certificate adds advice from other authorities and other information the council holds about the land. Narromine Shire Council's form (updated July 2025) orders a 10.7(2) certificate or a 10.7(2) and (5) certificate for each lot, and a drainage diagram. The council's forms page now links its 10.7 Planning Certificate Application to an online form.

When you need it

  • You are selling land in Narromine Shire and need the planning certificate and drainage diagram for the contract for sale.
  • You are buying and want the zoning and planning constraints confirmed.

How to fill it in

  1. 1

    Choose the certificate

Tick a 10.7(2) certificate or a 10.7(2) and (5) certificate. Both are charged per lot, so a property on several lots needs a certificate for each.

  2. 2

    Drainage diagram

Tick the drainage diagram if needed. The form says drainage diagrams are not available for rural properties or vacant land, so check availability with the council before ordering.

  3. 3

    Applicant and property

Give the applicant's name, address, contact number, email, reference and the date, then the property address, lot, DP and owner details.

Filing, lodging and service

  • Address correspondence to the General Manager, PO Box 115, Narromine NSW 2821, or email mail@narromine.nsw.gov.au. The council office is at 124 Dandaloo Street, Narromine; phone 02 6889 9999.
  • The council's forms page now offers the 10.7 application as an online form: use that if you can.
  • A fee applies per lot for each certificate and for a drainage diagram: check the council's current fees and charges.

Common mistakes

  • Ask the council first whether a drainage diagram exists if the land is rural or vacant.
  • Section 603 rates certificates use the council's separate Section 603 Application.

Frequently Asked Questions

What is the difference between a 10.7(2) and a 10.7(2) and (5) planning certificate?

A 10.7(2) certificate gives the prescribed planning information: zoning, the planning controls that apply, and constraints such as contamination, flooding and bush fire prone land. A 10.7(2) and (5) certificate includes all of that plus advice from other authorities and other information the council holds about the land.

Do I need a planning certificate to sell a property in NSW?

Yes. The NSW Government's selling guide says the contract for sale must contain a current section 10.7 zoning certificate issued by the local council, along with the title documents and a drainage diagram. The guide also says the contract must be prepared before the property is advertised for sale, so order the certificate early.

Why is a drainage diagram needed when selling?

The NSW Government's selling guide lists a drainage diagram among the documents that must be in a contract for the sale of land, so it is ordered from the council when the contract is being prepared. The guide says the contract must be prepared before the property is advertised for sale.
