What the Application for Certificates is for

A planning certificate under section 10.7 of the Environmental Planning and Assessment Act 1979 (NSW), formerly called a section 149 certificate, is issued by the local council and sets out the planning controls that apply to a parcel of land. A section 10.7(2) certificate shows the zoning, the state, regional and local planning controls, and constraints such as land contamination, flooding and bush fire prone land. A section 10.7(2) and (5) certificate adds advice from other authorities and other information the council holds about the land. Warrumbungle's 2026/2027 form also orders internal and external drainage diagrams, outstanding notices certificates under section 121ZP of the EP&A Act and section 735A of the Local Government Act 1993, searches for notices under other Acts, and inspections. The form says a 10.7(5) certificate must be bought with a 10.7(2); bought separately, it is only available to the original applicant within 4 weeks of the 10.7(2) being issued.

Frequently Asked Questions

What is the difference between a 10.7(2) and a 10.7(2) and (5) planning certificate?

A 10.7(2) certificate gives the prescribed planning information: zoning, the planning controls that apply, and constraints such as contamination, flooding and bush fire prone land. A 10.7(2) and (5) certificate includes all of that plus advice from other authorities and other information the council holds about the land.

Can I order a 10.7(5) certificate on its own in Warrumbungle?

Only within 4 weeks of the 10.7(2) certificate being issued, and only by the original applicant. Otherwise it must be ordered with the 10.7(2).

Why is a drainage diagram needed when selling?

The NSW Government's selling guide lists a drainage diagram among the documents that must be in a contract for the sale of land, so it is ordered from the council when the contract is being prepared. The guide says the contract must be prepared before the property is advertised for sale.
