Notice of Change of Address for Service (Form 25)

Every party who files documents must give the court an address for service: the party's name, any law firm and responsible solicitor, a physical address for service (in South Australia if no email is given, otherwise in Australia), an email address unless one cannot reasonably be obtained, and a contact phone number (r 44.1(2) of the Uniform Civil Rules 2020 (SA)). That address remains the party's address for service until a notice of acting, notice of cessation of acting or notice of change of address for service shows a different one (r 44.1(5)). Rule 44.2(1) requires a notice of change of address for service in Form 25 to be filed and served on all parties within 7 days of any change to the address, email address or phone number. Documents are validly served at the address for service, including by email, so an out-of-date address can mean you miss documents served on you (r 44.3).

When you need it

• You have moved, or your physical address for service has changed.
• Your email address or phone number for service has changed.
• Your law firm has moved office or changed its contact details.
• Not for a change of the responsible solicitor within a firm, or a change of law firm: those need a notice of acting in Form 23 (rr 44.2(2), 25.2).

   Complete the heading

   Delete all but the correct court, add Court of Appeal, minor civil or the list if applicable, and name the parties as they appear in the case, with the case number.

   Enter your new address for service

   Give your party title, full name and any law firm and solicitor, then the new street address, suburb, state, postcode, country, email and phone. Duplicate the panel if several parties share the change.

   Date the notice

   The notice states that the party's address for service is now as shown. Insert the date.

• File the notice in the case through CourtSA or at a registry within 7 days after the change (r 44.2(1)).
• Serve it on all other parties within the same 7 days (r 44.2(1)).
• If a document sent to another party's address for service did not reach them, the sender must tell that party or, failing that, the court (r 44.1(6)).

• Until you file the notice, documents served at your old address or email still count as served on you (r 44.1(5)).
• If you give an email address, the physical address may be anywhere in Australia; without one it must be in South Australia (r 44.1(2)(c)).
• The court may strike out an address for service if documents sent to it are not being received (r 44.1(7)), so keep it current.
