What Form 48 is for
Rule 675 of the Supreme Court Rules 2000 (Tas) says an appellant who does not prosecute an appeal is not taken to have abandoned it until the appellant has filed with the Principal Registrar, and served on the respondent, a notice of discontinuance (r 675(1)). The notice must be in the prescribed form (r 675(2)), which is Form 48. On filing and service, the appeal is taken to be dismissed with costs (r 675(3)). The rule sits in Part 27 Division 1 (appeals from a judge to the Full Court), and also applies to appeals from inferior courts under Division 2 (r 682(4)) and to applications for leave to appeal (r 679(2)).
When you need it
- You have lodged an appeal to the Full Court, or an appeal from an inferior court under Part 27 Division 2, and no longer wish to pursue it.
- You want to end an application for leave to appeal.
- The appeal has been resolved by agreement and the appellant needs to formally bring it to an end.
How to fill it in
- 1
Copy the heading
Use the appeal heading and number, with the appellant and respondent named as in the notice of appeal.
- 2
State what is discontinued
The form states that the appellant discontinues the appeal. Adjust the wording if it is an application for leave or a partial discontinuance ("or as the case may be").
- 3
Date and sign
The appellant's practitioner signs, or the appellant if acting in person.
- 4
Address and footer
Address it to the Registrar and to the respondent's practitioners or the respondent in person, and complete the footer.
Filing, lodging and service
- File the notice with the Principal Registrar (r 675(1)), in person, by post or by approved email lodgment (rr 83, 87A).
- Serve it on the respondent. The appeal is taken to be dismissed with costs only once it is both filed and served (r 675(3)).
Common mistakes
- Simply not prosecuting an appeal does not end it; file and serve the notice (r 675(1)).
- Check the costs position before filing, because dismissal with costs is the default consequence.
- Keep proof of service on the respondent with the file.
