Workers Compensation and Injury Management Act 2023

For law practices: this form maps to the published matter-field vocabulary, so your practice management system fills it from your matter data - on your own machine. Practice management systems can fetch and assemble it through the document assembly API.
What Form AS13 is for
Under s 365(2) of the Workers Compensation and Injury Management Act 2023 (WA), a party at an arbitration hearing may appear in person or be represented by a legal practitioner, an authorised agent, or a person authorised by the rules (for a body corporate, a director, secretary or authorised officer: r 22 of the Arbitration Rules 2024). Rule 23 requires a representative to notify the Registrar of an appointment either in the first document they lodge for the party (giving their address for receiving documents) or by a notice of appointment within 3 working days after being appointed. A representative whose authority is limited must say so (r 23(2)), and must notify the Registrar within 3 working days of ceasing to act (r 23(4)). AS13 is the form for those notices.
When you need it
- You are a legal practitioner or authorised agent newly appointed by a worker, employer, dependant or other party to an arbitration, and the appointment has not been notified in the first document you lodge.
- You have stopped acting for a party and must notify the Registrar within 3 working days (r 23(4)).
- You are taking over from a previous representative.
How to fill it in
- 1
Section A - case details
Enter the case number, the applicant and the respondent.
- 2
Section B - representative details
Give the firm or company name, the name of the solicitor or authorised agent, postal address, phone, mobile and email, and tick which party you represent (worker, employer, dependant or other).
- 3
Section C - representation details
Complete Q6 with the effective date of appointment, or Q7 with the effective date of cessation, and name any previous representative. If your authority is limited or restricted, say how; otherwise the Registrar may assume it is not (r 23(2) and (3)).
- 4
Section D - signature
The representative signs, prints their name and dates the form.
Filing, lodging and service
- Give the notice within 3 working days of the appointment or cessation (r 23(1)(b) and (4), and the note on the form).
- Representatives are generally not EDS exempt, so lodge through WorkCover WA Online (rr 61, 62). The form also lists email (arbitration@workcover.wa.gov.au), in person at 2 Bedbrook Place, Shenton Park WA 6008, and post; rule 63 allows those channels if you are EDS exempt or WorkCover WA Online is unavailable while the office is open.
Common mistakes
- You can skip this form on appointment if the first document you lodge for the party gives your address as the address for receiving documents (r 23(1)(a)).
- Remember to lodge a cessation notice when you stop acting, so documents stop coming to you.
- An arbitrator may refuse to let an employer or insurer be represented by a lawyer or agent if the worker is not represented (s 365(3)). Family members and friends cannot represent a party, as WorkCover WA's guide explains.
