Legal Project Management Plan & Checklist
Step-by-step plan for a worker's workers compensation dispute in Western Australia, through WorkCover WA conciliation, arbitration and appeal.
How do I dispute a workers compensation decision in Western Australia?: A party to a dispute applies to the Director of the Workers Compensation Conciliation Service for conciliation in the approved form (s 311 Workers Compensation and Injury Management Act 2023; r 5 Conciliation Rules 2024). Arbitrators have exclusive jurisdiction to determine disputes (s 304), but an application for arbitration cannot be accepted unless it is accompanied by a certificate that the dispute is not suitable for conciliation or a conciliator's certificate identifying the matters not resolved (s 332(1)). WorkCover WA's own guidance says an application to the Arbitration Service can only be made after a Certificate of Outcome is issued.
How long does workers compensation conciliation take in WA?: Conciliation ends when the parties agree on everything, the conciliator believes agreement is unlikely, the time limit expires or the applicant discontinues (s 319(1)). The time limit expires 56 days after the Director accepts the application and can be extended by up to a further 56 days in total (r 15 Conciliation Rules 2024). A conciliator can direct interim payments of income compensation for up to 12 weeks (s 320(3)).
What is the time limit to apply for arbitration in a WA workers compensation dispute?: A general application must be lodged with the Registrar within 28 days after the certificate of outcome or the not-suitable certificate is issued (r 11 Arbitration Rules 2024). The Registrar can extend time only for extenuating circumstances (r 12). The application must be lodged with the documents the worker proposes to rely on, including medical reports, witness statements and expert statements (r 16).
Can a worker appeal an arbitrator's decision in WA?: Only with the District Court's leave, on a question of law, after written reasons have been given; the leave application cannot be made later than 28 days after the written reasons are given (s 391(1), (2) and (4)). Written reasons must be requested within 14 days after the decision if the rules do not require them (s 350(3)). The District Court cannot order costs against a worker because an appeal succeeded (s 400(1)).
Jurisdiction: Workers Compensation Conciliation Service and Workers Compensation Arbitration Service established by WorkCover WA under Part 6 of the Workers Compensation and Injury Management Act 2023, with appeals by leave to the District Court of Western Australia.
The Process at a Glance: The worker's lawyer confirms the claim was made within 12 months, checks the insurer's liability decision notice or deemed acceptance, and requests relevant documents from the employer or insurer. After a genuine attempt to resolve the dispute, the Application for Conciliation is lodged online with supporting documents and, where needed, a Statement of Social and Financial Circumstances. At conciliation the worker may obtain interim compensation directions or a finalising order by consent. If matters remain unresolved, the Application for Arbitration is lodged within 28 days of the certificate of outcome with all evidence. The arbitrator manages disclosure, interlocutory applications, witness summonses and the hearing, then decides. Costs, enforcement, an appeal by leave on a question of law, or a registered settlement agreement follow.
Key Legislation: Workers Compensation and Injury Management Act 2023 (WA) ss 25 to 30, 36, 52, 77, 78, 149 to 156, 303 to 400 and 420; Workers Compensation and Injury Management Conciliation Rules 2024 rr 5 to 17, 20, 26, 27, 32 and 33; Workers Compensation and Injury Management Arbitration Rules 2024 rr 11 to 23, 28 to 39, 42 to 51, 54 and 55; Workers Compensation and Injury Management Regulations 2024 regs 19 and 22; District Court Rules 2005 (WA) rr 51, 53 and 55 for appeals.
