What the Certificates Under Section 10.7 Application is for
A planning certificate under section 10.7 of the Environmental Planning and Assessment Act 1979 (NSW), formerly called a section 149 certificate, is issued by the local council and sets out the planning controls that apply to a parcel of land. A section 10.7(2) certificate shows the zoning, the state, regional and local planning controls, and constraints such as land contamination, flooding and bush fire prone land. A section 10.7(2) and (5) certificate adds advice from other authorities and other information the council holds about the land. Wentworth Shire Council says its 10.7(2) and (5) certificate also covers current development consents, non-compliance matters about development approvals or building and health items, and the services available to the property. The July 2026 form also orders a section 735A certificate under the Local Government Act 1993 and a copy of the sewer diagram.

Frequently Asked Questions
What is the difference between a 10.7(2) and a 10.7(2) and (5) planning certificate?
A 10.7(2) certificate gives the prescribed planning information: zoning, the planning controls that apply, and constraints such as contamination, flooding and bush fire prone land. A 10.7(2) and (5) certificate includes all of that plus advice from other authorities and other information the council holds about the land.
Do I need a planning certificate to sell a property in NSW?
Yes. The NSW Government's selling guide says the contract for sale must contain a current section 10.7 zoning certificate issued by the local council, along with the title documents and a drainage diagram. The guide also says the contract must be prepared before the property is advertised for sale, so order the certificate early.
