What Form 2 is for
Rule 2.13(3) of the Federal Court Rules 2011 requires a document in a proceeding in which there is no respondent to include a title and details in accordance with Form 2. Instead of naming opposing parties, the title reads 'The application of' the applicant 'under the' Act under which the proceeding is brought, with a second Act added if relevant. As with all titles, the heading must also refer to the District Registry and Division (r 2.13(1)) and identify the proceeding (r 2.13(5)).
When you need it
- The proceeding is brought by an applicant alone, with no respondent named.
- You need a title for the originating application or any later document in that proceeding.
- If a respondent is later joined, later documents use the Form 1 or Form 3 title instead.
How to fill it in
- 1
Insert the document title
Replace '[Title - no respondent]' with the name of the document.
- 2
Complete the number, registry and Division
Insert the proceeding number (r 2.14), the District Registry and the Division.
- 3
Name the applicant and the Act
Complete 'The application of' with the applicant's name and 'under the' with the full name of the Act under which the proceeding is brought. Add the second Act only if needed, otherwise delete that line.
- 4
Date, sign and add the footer
Insert the content, then date and sign as the applicant or the applicant's lawyer (r 2.15) and complete the footer (r 2.16).
Filing, lodging and service
- A title forms part of another document. File that document through eLodgment or at a registry as its rule requires.
- Fees and service requirements depend on the document being filed.
Common mistakes
- Use the Act's full, correct name and year, since it identifies the proceeding.
- Keep the title identical on every document in the proceeding.
