Magistrates' Court of Victoria Forms

The affidavit in support of application is the Magistrates' Court of Victoria form used to give sworn evidence for an application for re-hearing (Form 46B).

Form 72B is the affidavit a judgment creditor swears in the Magistrates' Court of Victoria to support an attachment of earnings summons. It is filed with Form 72A.

Form 6A is the affidavit or declaration of service used in the Magistrates' Court of Victoria to prove when, where and how a court document was served. The person who served it signs it.

Form 61A is the Magistrates' Court of Victoria application for an order that a judgment debt be paid by instalments. It is also used to vary or cancel an instalment order.

Form 21A is the Application for Order in Default of Defence in the Magistrates' Court of Victoria. A plaintiff uses it to ask for judgment when the defendant has not given notice of defence in time.

Form 46B is the application for re-hearing in the Magistrates' Court of Victoria. A party who was absent when a final civil order was made uses it to ask for the order to be set aside.

Form 72F is the Attachment of Earnings Order in the Magistrates' Court of Victoria. It directs a judgment debtor's employer to deduct a set amount from each pay and send it to the judgment creditor.

Form 72A is the attachment of earnings summons in the Magistrates' Court of Victoria. A judgment creditor uses it to seek an order that the debtor's employer pay part of the debtor's wages.

Form 4AB is a lawyer's certificate in the Magistrates' Court of Victoria that the client already made an overarching obligations certification within 2 years.

Form 5A is the Complaint that starts a civil claim in the Magistrates' Court of Victoria. The plaintiff files it with a statement of claim, then serves it on the defendant with two blank notices of defence.

Form 10A is the counterclaim in the Magistrates' Court of Victoria. A defendant uses it to bring their own claim against the plaintiff, and anyone joined, in the same proceeding.

Form 67B is the examination sheet for an individual judgment debtor in the Magistrates' Court of Victoria. It is served with a Form 67A summons and records the debtor's sworn answers about income, assets and debts.

Form 72C is the judgment debtor's statement of financial position in the Magistrates' Court of Victoria. It is served with an attachment of earnings summons for the debtor to fill in.

Form PSIO5 records the minutes of proposed consent orders in a Victorian personal safety intervention order case. Lawyers or police complete it for the Magistrates' Court.

Form 10B is the Notice of Reply used in the Magistrates' Court of Victoria to defend a federal jurisdiction (substituted proceeding) complaint or summons. It applies under Part 3A of the VCAT Act.

Form 8A is the Notice of Defence used in the Magistrates' Court of Victoria to tell the plaintiff and the court you intend to defend a civil complaint. It sets out your defence to the statement of claim.

Form PSIO3 is the notice used in the Magistrates' Court of Victoria to ask for a personal safety intervention order application to be withdrawn.

Form 4A is the Overarching Obligations Certification in the Magistrates' Court of Victoria. Each party personally certifies they have read and understood their duties under the Civil Procedure Act 2010.

Form 4B is the proper basis certification for civil cases in the Magistrates' Court of Victoria. It certifies that the allegations, denials and claims in a document have a proper basis.

Form 42AA is the subpoena for production to registrar in the Magistrates' Court of Victoria. A party with a lawyer uses it to have a non-party produce documents before the hearing.

Form 42A is the subpoena to attend to give evidence in a civil case in the Magistrates' Court of Victoria. It orders a witness to come to court at a set date, time and place.

Form 42B is the subpoena to produce in a civil case in the Magistrates' Court of Victoria. It orders a person or company to produce specified documents or things to the court.

Form 46A is the Summons for an interlocutory application on notice in a civil proceeding in the Magistrates' Court of Victoria. It is used, for example, to extend a complaint or seek procedural orders.

Form 5 is the warrant of possession for federal jurisdiction residential tenancy cases in the Magistrates' Court of Victoria. It authorises police to return premises to the applicant.

Form 68A is the request for, and warrant to seize property in, the Magistrates' Court of Victoria. A judgment creditor uses it so the sheriff can seize and sell a debtor's goods.
