Application for Amendment to Schedule of Unit Entitlements (AP2SP)

Under section 12 of the Strata Titles Act 1988 (SA), only the strata corporation can apply to amend a deposited strata plan. It must show the Registrar-General that the application follows a unanimous resolution passed at a properly convened meeting, and that anyone with an encumbrance registered over units or common property affected by the amendment consents (s 12(2)). Where the amendment varies the unit entitlements, or affects the relative value of the units, the application must include a fresh schedule of unit entitlements certified correct by a licensed valuer (s 12(3)(d)). Alternatively, the Environment, Resources and Development (ERD) Court may order an amendment, including one varying unit entitlements, on application by the corporation, a unit holder, another registered interest holder or an insurer (s 13). Form AP2SP is the Registrar-General's form for substituting the new schedule.

When you need it

• The strata corporation has passed a unanimous resolution to change the unit entitlements on its strata plan.
• The ERD Court has ordered the unit entitlements to be varied under section 13 of the Strata Titles Act 1988.
• A licensed valuer has prepared and certified a fresh schedule of unit entitlements.

   Heading

   Strike through section 12 or section 13, whichever does not apply. If you are amending a prior application, give that dealing number.

   Application to the Registrar-General

   Insert the strata corporation number and its postal address. Keep paragraph (1) for a resolution-based application or paragraph (2) for a court order, inserting the order's date, and strike through the other. In paragraph (3) insert the strata plan number.

   Supporting documents

   Attach the valuer's certificate and the unit entitlement sheet (the valuer inserts the strata plan number) and a copy of the minutes of the unanimous resolution, certified by an officer of the strata corporation. For a court order, attach a copy of the sealed order. List them in the supporting documentation panel.

   Execution by the strata corporation

   Date the form and affix the corporation's common seal, or have a practitioner certify under client authorisation and strike through the execution panel.

   Consents

   Registered interest holders of any unit whose entitlement changes sign a consent, giving their full name and address (and ACN or ABN) and the interest held. Personal signatures need an adult witness who is not a party (Real Property Act 1886 s 267).

• Lodge the AP2SP and attachments with Land Services SA. Paper documents are lodged at Level 9, 101 Grenfell Street, Adelaide, through the Face to Face or Drop and Go service.
• A lodgement fee applies. Check Land Services SA's current fees page.
• Certification can be given by a legal practitioner or registered conveyancer, or by a self-represented party, who makes only the certifications about retaining evidence and the document being correct and compliant.
• Number every page consecutively and use a Form B1 annexure if space runs out.

• If a consenting party's name differs from the title, lodge an application to note the change of name before the AP2SP.
• Any change to the strata site's address must be authorised by a letter from the council attached to the application.
