Real Property Act 1886

For law practices: this form maps to the published matter-field vocabulary, so your practice management system fills it from your matter data - on your own machine. Practice management systems can fetch and assemble it through the document assembly API.
What RT is for
Section 78 of the Real Property Act 1886 (SA) lets a registered proprietor who holds land under one or more certificates of title apply for one certificate covering all of that land, or several certificates each covering part of it. When the new certificates issue, the Registrar-General cancels the old ones and notes the cancellation on them. Land Services SA lists Form RT as 'Request for New Titles', and its guidance notes say it is for new titles that do not involve a plan of division. The application must be accompanied by the prescribed new title fee for each title to be issued.
When you need it
- You hold land under several titles and want them combined onto one certificate, or one title split into several certificates for existing parcels, without dividing the land.
- The land is already divided into separate parcels and no new plan of division is needed.
- You are the registered proprietor, or a practitioner acting for all of the registered proprietors.
How to fill it in
- 1
Land description
State every certificate of title reference affected, for example 'Whole of the land in CT Volume ... Folio ...'.
- 2
Applicants
Insert the full name and address of every registered proprietor of the land.
- 3
Number of new certificates
Insert how many new certificates of title are to issue, in the panel and in the operative wording.
- 4
Instructions
Set out exactly how the new certificates are to issue, for example which allotments or parcels go on each new title. Use a Form B1 annexure if you need more space.
- 5
Signature or certification
All applicants date and sign the form; a body corporate must follow any prescribed execution formalities. If a lawyer or registered conveyancer signs under client authorisation, strike through the signature panel and complete the certification. The guidance notes say the certifications do not apply when the applicants sign themselves.
Filing, lodging and service
- A request for new titles is not on the Registrar-General's mandatory electronic lodgement list. Paper documents are lodged at Land Services SA, Level 9, 101 Grenfell Street, Adelaide, through the Face to Face service for members of the public or the Drop and Go service for industry professionals.
- Pay the prescribed new title fee for each title being issued. Check the current fee on Land Services SA's fees page or LTO fee calculator.
- All panels must be completed. Number every page consecutively and use permanent black or blue ink for handwriting.
Common mistakes
- If the land needs to be divided into new allotments, Form RT is the wrong form: a plan of division under Part 19AB is needed instead (for example Form RTU or RTC).
- The Registrar-General may refuse to accept a form or annexure that does not meet the LTO panel form standards.
- If a requisition from Land Services SA is not answered within 2 months, the Registrar-General can give notice and reject the instrument, and the fees are forfeited (s 220(e)).
Frequently Asked Questions
How do I get separate titles for land on one certificate of title in SA?
If the land already consists of separate parcels, the registered proprietor can lodge Form RT asking for several certificates each covering part of the land (s 78), paying a new title fee for each. If new allotments must be created, a plan of division is needed instead.
Is Form RT the same as getting a copy of my title?
No. Form RT asks the Registrar-General to cancel existing certificates and issue new ones. A copy of a title is a search product ordered separately.
