Purpose of this Guide: Use this plan when a debtor has been served with court proceedings in New Zealand but has failed to file a Statement of Defence within the statutory deadline. This guide helps legal practitioners compile default applications, obtain administrative sealing for liquidated demands, or navigate Formal Proof Hearings for unliquidated claims.
Jurisdiction: High Court and District Court of New Zealand (national jurisdiction). This fork is governed by Rule 15.4 of both the District Court Rules 2014 and High Court Rules 2016.
The Process at a Glance: The process starts by verifying the expiry of the defence pleading window. The practitioner then drafts and files the default application package, including an affidavit of service and a verifying affidavit. If the debt is a liquidated demand, judgment is entered administratively by the Registrar. If the demand is unliquidated, the practitioner prepares affidavit evidence of damages and represents the client at a Formal Proof Hearing before a judge.
