Jurisdiction: New Zealand (National). The regulatory body governing unit title disclosures is the Ministry of Justice, and disputes are adjudicated by the Tenancy Tribunal. Transactions are registered electronically under the Land Transfer Act 2017 via the Land Information New Zealand (LINZ) Landonline platform. LINZ Landonline and Tenancy Tribunal.
The Process at a Glance: The practitioner begins by reviewing the body corporate rules, minutes, and financial statements. A Pre-Contract Disclosure Statement is prepared and served on the purchaser before the contract is signed. Prior to settlement, the practitioner orders the Pre-Settlement Disclosure Statement from the body corporate manager, certifying and serving it on the buyer no later than 5 working days before settlement. The levies account is reconciled, operational and maintenance fund apportionments are calculated for the settlement statement, and ownership change notices are served post-settlement.
