Legal Project Management Plan & Checklist
Purpose of this Guide: Use this guide when the purchaser is an overseas person under the Overseas Investment Act 2005 and requires consent from the Overseas Investment Office (OIO) to purchase residential or lifestyle land. This pathway covers the preparation and monitoring of the OIO consent condition, coordinating with the OIO, and registration compliance.
Jurisdiction: New Zealand (National). Regulatory oversight is provided by the Overseas Investment Office (OIO). Transfers are registered electronically via Landonline under the Land Transfer Act 2017.
The Process at a Glance: The practitioner begins by reviewing the OIO gateway requirements. A custom OIO consent condition is drafted and inserted into the ASPRE prior to execution. The practitioner assists the client in drafting and submitting the OIO consent application. Once consent is granted, the OIO consent number is recorded in Landonline, and registration is completed in accordance with section 51C.
Key Legislation and Case Law: Overseas Investment Act 2005 - s 51A (Residential Land Statement), s 51C (practitioner certification), and s 6 (definition of overseas person). Key cases: Attorney-General v Overseas Investment Office [2022] NZHC 341 regarding the standard of review for consent applications.
