Land Title Act 1994

For law practices: this form maps to the published matter-field vocabulary, so your practice management system fills it from your matter data - on your own machine. Practice management systems can fetch and assemble it through the document assembly API.
What Form 18 is for
Form 18 records the consent of someone who is not a party to the transaction but whose consent or approval is needed. Where a consent or approval is required under the Land Title Act 1994 (Qld) or another Act, it must be given on a Form 18 unless the main form has its own provision for it (Land Title Practice Manual (LTPM) [18-2000]). Common examples are a mortgagee consenting to a lease or amendment of lease (needed for the lease to bind the mortgagee, s 66), mortgagees and sublessees of the lessee consenting to a surrender of lease (s 69(2)), mortgagees and benefiting lessees consenting to a surrender of easement (s 90(3)), and a lessee consenting to a new easement. Form 18 cannot be lodged on its own. Separate forms (18A, 18B and 18C) are used for consents and approvals to survey plans and community management statements.
When you need it
- A bank or other registered mortgagee is consenting to a lease, sub-lease or amendment of lease over the mortgaged land (LTPM [7-0040]).
- The mortgagees and sublessees of a lessee are consenting to a Form 8 surrender of lease (LTPM [8-2000]).
- Mortgagees of the benefited lot, or lessees who benefit, are consenting to a Form 10 surrender of easement, or a lessee of the burdened lot is consenting to a new Form 9 easement (LTPM [10-2000], [9-2082]).
- A planning body is giving an approval that the LTPM says should be on a Form 18, such as for a lease of part of a lot for more than ten years including options (LTPM [7-0050]).
How to fill it in
- 1
Item 1: land
Insert the lot on plan description, with the plan prefix (for example 'Lot 27 on RP 204939'), and the title reference.
- 2
Item 2: the instrument being consented to
Insert the type and date of the instrument or document the consent relates to (for example 'Lease', dated 1 March 2026) and the full names of the parties to it (LTPM [18-4020]).
- 3
Item 3: the instrument under which consent is required
Insert the type and dealing number of the registered instrument that gives the consenting party their interest, for example 'Mortgage' and its mortgage number, and the full name of the consenting party (LTPM [18-4030]).
- 4
Item 4: execution
The consenting party signs and dates the form. An individual signs in front of a witness listed in Schedule 1 of the Land Title Act 1994 (for example a JP, commissioner for declarations or lawyer). A company or bank signs in the way it is permitted to sign under the law (s 161).
- 5
Page numbering
Number the page so it fits into the page sequence of the instrument it is attached to, because it forms part of that instrument.
Filing, lodging and service
- A Form 18 cannot be lodged on its own. It must be attached to, form part of and be deposited with the instrument or document being consented to (LTPM [18-2000]).
- No lodgement fee is payable for a Form 18 (LTPM [18-8000]) and it does not need a duty notation (LTPM [18-4050]). The fee for the main instrument applies.
- Lodge it through whatever channel the main instrument uses: post, eLodgement or, for an electronic lease, as an attachment through an electronic lodgment network (mortgagee consent is a permitted attachment for a Form 7 lodged electronically).
- The Registrar does not enforce private contractual consent requirements. If an interest is registered without a consent your contract requires, the person entitled to give that consent may be able to defeat it (LTPM [18-2000]).
Common mistakes
- A mortgagee's consent is not needed for a lease to be registered, but without it the lease is not valid against the mortgagee (s 66). Decide whether you need it before lodging.
- Make sure the details in Item 2 match the instrument exactly (type, date and parties), so the consent clearly attaches to it.
- Do not confuse Form 18 with Form 18A (owners' consent to a survey plan), 18B (planning body approval of a survey plan) or 18C (community management statement notation).
Frequently Asked Questions
Where do I obtain the dealing number for the Form 18 general consent?
The dealing number in Item 3 is the number of the registered instrument under which the consent is needed, usually the consenting party's own mortgage or lease. It appears on a current title search for the lot, under 'Easements, encumbrances and interests' (for example 'MORTGAGE No [number]'). Title searches can be bought from Titles Queensland. The instrument you are seeking consent to (Item 2) does not need a dealing number: it is identified by its type, date and parties, and gets its own number when it is lodged.
Is Form 18 the general request form?
No. Form 18 is the General Consent. The General Request is Form 14, used to ask the Registrar to record things such as a change of name or withdrawal of a caveat.
Can I get the Form 18 general consent in Word format from the titles office?
Yes. Titles Queensland's forms page offers Form 18 (version 5) as a PDF and as a Word template (DOTX).
Is there a fee to lodge a Form 18?
No. The LTPM states that no fees are payable for lodging a Form 18, although the instrument it is attached to attracts its own lodgement fee.
