Lodgement of Resolution (LR)

Clause 2 of the Schedule (Transitional provisions) to the Community Titles Act 1996 (SA) lets a strata corporation under the Strata Titles Act 1988 decide by ordinary resolution that the Community Titles Act, and not the Strata Titles Act, will apply to the corporation and its strata scheme. An ordinary resolution is a simple majority of votes of members present and voting at a properly convened meeting. The corporation must lodge a certified true copy of the resolution with the Registrar-General, who files it with the strata plan (cl 2(2)). From filing, the strata plan is treated as a primary strata plan of community division, the units become strata lots, the common property vests in the lot owners, the corporation continues as a community corporation and its articles continue as by-laws (cl 2(3)). Form LR is the approved form for that lodgement.

When you need it

• Your strata corporation has passed an ordinary resolution at a properly convened meeting to move the scheme to the Community Titles Act 1996.
• You are the officer of the strata corporation lodging the resolution so that it takes effect.
• Note: the Community Titles Act does not apply to the scheme until the resolution is filed.

   Land description

   Insert the title references for every certificate of title in the strata scheme, including each unit and the common property, for example 'Whole of the land in CT Volume ... Folio ...'.

   Officer and corporation

   Insert the full name and address of the officer of the strata corporation making the application, and the strata corporation number.

   Details of the resolution

   Complete where and when the meeting was held and confirm the corporation decided by ordinary resolution that the Community Titles Act 1996 and not the Strata Titles Act 1988 will apply. The officer signs and dates the notice.

   Certificate of true copy

   An officer completes the certificate that the attached copy of the resolution is a true copy. This matches Form 8 in Schedule 1 of the Community Titles Regulations 2026, whose note requires the attached copy to be endorsed as the copy referred to in the certificate and signed by the certifying officer.

   Attach the resolution

   Attach the certified copy of the resolution (the guidance notes say a copy of the meeting minutes) and list it in the supporting documentation panel.

• Lodge Form LR with Land Services SA on paper. It is not on the mandated electronic lodgement list.
• The guidance notes say the LR cannot be lodged in series with a Form AP.
• On filing, the Registrar-General either issues new certificates of title stating the scheme is under the Community Titles Act, or endorses the existing certificates to that effect (cl 2(4)).
• A lodgement fee may apply. Check Land Services SA's current fee schedule.

• The resolution must be passed at a properly convened meeting (Schedule cl 1); it is the legal basis for the change, so keep the notice of meeting and minutes.
• Proceedings already started under the Strata Titles Act 1988 can be continued and completed under that Act (cl 2(5)).
• The guidance notes still refer to the Community Titles Regulations 2011. Those were replaced by the Community Titles Regulations 2026 from 1 September 2026; the certification is still Form 8.
