Purpose of this Guide: Use this fork when representing an accused in the Provincial Court of British Columbia. It guides defence counsel through the Criminal Caseflow Management Rules, pre-trial conferences, and date setting with Judicial Case Managers.

The Process at a Glance: The process begins with scheduling a mandatory Criminal Pre-Trial Conference (PTC) with a PTC judge. Counsel drafts and files the BC Form 2 Statement Identifying Issues and Witnesses, preferably at the arraignment hearing. Dates are negotiated and set through the Judicial Case Manager. Counsel files a BC-specific Designation of Counsel to permit appearances without the accused. Substantive pre-trial applications are served and filed at least thirty days before the hearing date. For complex hearings, counsel evaluates the appointment of a case management judge. Finally, counsel conducts the inquiry, cross-examines key witnesses, and updates the file following the committal decision.
Key Legislation and Case Law: Governed by the Criminal Code (Justice Laws) and the British Columbia Provincial Court Criminal Caseflow Management Rules (BC Legislation). Scheduling procedures comply with BC Provincial Court Criminal Practice Directions. Substantive motions utilize the BC Notice of Application form.
