Legal Project Management Plan & Checklist
Purpose of this Guide: Use this fork when your client is subject to Ontario's Sex Offender Registry under Christopher's Law 2000, SO 2000 c 1, either in addition to or instead of a federal SOIRA order. Christopher's Law is strictly mandatory - there is no judicial discretion, no exemption pathway, no discretionary order, and no termination application available. The duty to report ends only when a 10-year reporting period runs out, or on proof of a pardon or record suspension under the Criminal Records Act RSC 1985 c C-47 or of the conviction being overturned (s. 7); the record is deleted only on a free pardon, an overturned conviction or finding, or 50 years after death (s. 9.1). This fork exists because many practitioners erroneously assume that a successful federal SOIRA exemption resolves all registration obligations for an Ontario client, when in fact Christopher's Law continues independently.

Jurisdiction: Provincial - Ontario, under Christopher's Law 2000, SO 2000 c 1, as last amended by S.O. 2025, c. 24, Sched. 3, and Ontario Regulation 69/01 (as amended by O. Reg. 372/25). For federal SOIRA obligations running in parallel, see the parent plan.
The Process at a Glance: Determine whether Christopher's Law applies using the residency deeming rules in O. Reg. 69/01, s. 1 (as amended by O. Reg. 372/25) - an offender is deemed resident in Ontario after 15 consecutive days, or 15 non-consecutive days in any 30-day period, in the province. Advise the client that no judicial exemption exists and that the duty to report arises on conviction for a 'sex offence' as defined in s. 1(1) of the Act and O. Reg. 69/01, s. 1.1; no order is made. Explain the reporting period - 10 years after first reporting if the maximum sentence for the offence is not more than 10 years; life if it is more than 10 years or there is more than one sex offence (s. 7(1)). Note the 2025 amendment to s. 10 (S.O. 2025, c. 24, Sched. 3), which widened the bodies to which registry information may be disclosed. Prepare and deliver the Christopher's Law compliance checklist. Assess record suspension eligibility: proof of a record suspension ends the duty to report (s. 7(4)).
Key Legislation and Case Law: Christopher's Law 2000 SO 2000 c 1 - creates the Ontario Sex Offender Registry (OSOR). O Reg 372/25 - amended O. Reg. 69/01; s. 1 of that regulation deems an offender resident after 15 consecutive days, or 15 non-consecutive days in any 30-day period. Protect Ontario by Cutting Red Tape Act, 2025 (S.O. 2025, c. 24), Sched. 3 - widened the disclosure of registry information for crime prevention or law enforcement purposes (Christopher's Law, s. 10(3) to (3.0.3)). Ontario AG v G 2020 SCC 38 - the SCC held that part of Christopher's Law infringed s 15(1) of the Charter by discriminating against people found not criminally responsible on account of mental disorder, and gave Ontario one year to amend it; the registry otherwise remains in force. Criminal Records Act RSC 1985 c C-47 - proof of a record suspension ends the duty to report under Christopher's Law (s. 7(4)); it does not delete the record (s. 9.1). Record suspension eligibility and application - 5 years after completion of sentence for summary conviction offences, 10 years for indictable offences. Non-compliance with Christopher's Law (s. 11(1)): a fine of up to $25,000, imprisonment for up to one year, or both, on a first offence; up to two years less a day on a subsequent offence.
