Purpose of this Guide: Use this plan when representing an appellant in British Columbia appealing an indictable conviction or sentence to the Court of Appeal. It follows BC's specific procedural timelines, transcript requisition rules, and compliance mechanisms.

The Process at a Glance: The appellant initiates the appeal by filing a Form 1 Notice of Appeal within 30 days of sentencing. Transcript orders must be confirmed within 4 weeks of filing. The appellant has exactly 16 weeks from the filing of transcripts to serve and file their factum. A Compliance Hearing is automatically scheduled for week 29, which is cancelled if the factum is filed on time. The appeal concludes with oral arguments before the appellate panel.
