The Process at a Glance: The practitioner verifies course enrollment, schedules, and expected graduation. The practitioner evaluates the student's part-time earning capacity. The practitioner models the academic budget including tuition, textbooks, and equipment, while excluding deferred HECS-HELP liabilities. Evidence is compiled, exhibited to the trial affidavit, and filed via the portal.
Key Legislation and Case Law: Governing law includes Section 66L(2)(a) of the Family Law Act 1975 (Cth). Student earning capacity is assessed in accordance with the principles established in Wadsworth and Wadsworth [2022] FCCA 2043. HECS-HELP debt exclusion is handled under Section 66K. eFiling is completed via the Commonwealth Courts Portal.
