Legal Project Management Plan & Checklist
Evicting a Queensland tenant for rent arrears: when the notice to remedy can issue, the 7-day remedy and notice periods, and the QCAT application.
When can a Queensland lessor give a notice to remedy breach for unpaid rent?: When the lessor believes on reasonable grounds that the rent has remained unpaid in breach of the agreement for at least 7 days (Residential Tenancies and Rooming Accommodation Act 2008 (Qld) s 280(1)(a)). The notice must be in the approved form (Form 11), and the allowed remedy period must not end earlier than 7 days after the notice is given (ss 325 and 328(1)).

Does accepting rent waive the arrears breach?: Demanding or accepting rent does not waive the tenant's breach or a notice to leave (s 278(1)). But if the tenant tenders the total rent the notice requires within the allowed remedy period and the lessor accepts it, that breach is waived (s 278(2) and (3)).
What notice to leave is needed for unpaid rent?: A notice to leave for an unremedied breach (Form 12) with a handover day at least 7 days after the notice is given (s 281; schedule 1 part 1). If the tenant stays, apply to QCAT for a termination order within 2 weeks after the handover day (s 293).
Jurisdiction: Queensland Civil and Administrative Tribunal, residential tenancy disputes. An application for a termination order because of a failure to leave is an urgent application and does not need a prior RTA dispute resolution request (ss 415 and 416).
The Process at a Glance: The tenancy agreement is reviewed to confirm the rent amount, due date and payment method, and the ledger is audited to confirm the rent has been unpaid for at least 7 days. The Form 11 is prepared, stating the arrears and the day by which they must be paid, allowing at least 7 days. If the tenant pays the full amount within the remedy period, the breach is waived. If not, a Form 12 notice to leave is given with a handover day at least 7 days later. If the tenant does not hand over vacant possession, a QCAT application for a termination order is filed within 2 weeks after the handover day. QCAT decides whether the breach justifies termination (s 337) and, if it makes the order, issues a warrant of possession (s 350(2)).
Key Legislation: Residential Tenancies and Rooming Accommodation Act 2008 (Qld) - s 278 (acceptance of rent and waiver), s 280 (notice to remedy breach, including rent unpaid for at least 7 days), s 281 (notice to leave for unremedied breach), s 293 (application within 2 weeks after the handover day), ss 325-326 and 328 (form of notices and allowed remedy period), s 337 (termination order), ss 350-351 (warrant of possession), ss 415-416 (urgent applications), schedule 1 part 1 (7-day notice period for unpaid rent). Queensland Civil and Administrative Tribunal Act 2009 (Qld).
