Legal Project Management Plan & Checklist
Purpose of this Guide: Welcome to the specialised practitioner roadmap for managing tree disputes (overhanging branches and tree root damage) in Queensland. Designed explicitly for property lawyers, arborist consultants, and affected property owners, this guide addresses dispute resolution under Chapter 3 of the Neighbourhood Disputes (Dividing Fences and Trees) Act 2011 (QLD). Additional forms are accessible via the Queensland Government Portal.
Jurisdiction: This guide applies to neighbour tree disputes in Queensland, Australia, and proceedings within the (). Note: tree dispute provisions under Chapter 3 do not apply to rural land exceeding 4 hectares, council-owned land, or state-owned land (s42). The tree must be a 'woody perennial plant, vine, bamboo, or palm' as defined under s45.
Governing Legislation: - Neighbourhood Disputes (Dividing Fences and Trees) Act 2011 (QLD) - Chapter 3 (Trees), ss42-68 - s42: Application scope (excludes rural land >4ha, council land, state land) - s45: Tree definition (woody perennial, vine, bamboo, palm) - s46: Affected land criteria (serious injury, serious damage, or substantial interference within 12 months) - s48: Tree-keeper definition - s57: Overhanging branches self-help provisions (branches >50cm past boundary, <=2.5m above ground) - s58: Cost recovery for overhanging branch removal (up to $300 per annum) - ss61-62: QCAT jurisdiction and application for tree disputes (Form 51, filing fee $392.40) - s66: Orders QCAT may make (removal, lopping, root barrier, compensation) - s67: Power to override Vegetation Protection Orders - s68: Orders regarding already-removed trees (compensation still available)
Process at a Glance: Tree disputes involve resolving overhanging branches, tree root damage to foundations, plumbing, or paving, or other interference caused by a neighbour's tree. (1) Document the damage with photographs and commission expert reports (arborist and/or structural engineer). (2) For overhanging branches extending more than 50cm past the boundary and less than or equal to 2.5m above ground, serve a Notice for Removal of Overhanging Branches (Form 3) under s57 giving the tree-keeper 30 days to remove them; if not removed, the affected owner may remove them and recover costs up to $300/year under s58. (3) For serious root damage or other interference, apply directly to QCAT (Form 51 - tree dispute application, filing fee $392.40). (4) QCAT must be satisfied the land is 'affected land' under s46 - meaning serious injury, serious damage, or substantial interference with use and enjoyment is occurring or likely within 12 months. (5) QCAT may appoint a tree assessor (cost up to $1,200 shared between parties). (6) QCAT may order removal, lopping, root barriers, compensation, and may override local Vegetation Protection Orders under s67.

Inspect the damage, confirm the tree species falls within the s45 definition, verify the land is not excluded under s42, obtain arborist and structural engineering reports, and establish tree causation under the s46 'affected land' criteria.
Verify all prerequisite documentation has been obtained, cross-reference against the statutory requirements for this matter type, and confirm compliance with practice direction protocols.

Vegetation Protection Orders (s67): QCAT has power to override local VPOs where the affected land criteria under s46 are met.
For overhanging branches (>50cm past boundary, <=2.5m above ground under s57), draft and serve a Notice for Removal of Overhanging Branches (Form 3), allow 30 days for compliance, and if not removed, exercise the self-help right and recover costs up to $300/year under s58.
