Legal Project Management Plan & Checklist
Ending a Queensland tenancy for objectionable behaviour: gathering evidence, the direct QCAT application without a notice to leave, and the warrant.
Can a Queensland lessor apply straight to QCAT for a tenant's objectionable behaviour?: Yes. A lessor may apply for a termination order without first giving a notice to leave if the tenant has harassed, intimidated or verbally abused the lessor, the lessor's agent or a person occupying or allowed on nearby premises, or is causing or has caused a serious nuisance to neighbours (Residential Tenancies and Rooming Accommodation Act 2008 (Qld) ss 297 and 335(1)(e)). It is an urgent application, so no prior RTA dispute resolution request is needed (ss 415 and 416).

What does QCAT consider on an objectionable behaviour application?: Whether the ground is established and the behaviour justifies terminating the agreement, having regard to whether it was recurrent and how often and, for harassment, intimidation or verbal abuse, its seriousness (s 345). A separate serious breach ground applies where the lessor reasonably believes the premises were used for illegal activity or there was intentional or reckless serious damage or endangerment (s 297B).
What happens after QCAT makes a termination order?: The tribunal must issue a warrant of possession, which takes effect not later than 3 business days after issue and ends 14 days after taking effect unless the tribunal sets a later day for special circumstances (ss 350(2) and 351).
Jurisdiction: Queensland Civil and Administrative Tribunal, residential tenancy disputes under the Residential Tenancies and Rooming Accommodation Act 2008 (Qld). Public and community housing lessors use separate provisions (ss 297A and 345A).
The Process at a Glance: Document the behaviour as soon as the lessor becomes aware of it: written statements from affected neighbours, photographs, CCTV footage, police occurrence reports with QPRIME numbers, and any orders from related criminal or domestic violence proceedings. Decide whether the conduct fits the objectionable behaviour or serious breach grounds for a direct application, or whether the notice to remedy and notice to leave pathway is more appropriate. For a direct application, file the QCAT application with the supporting evidence and serve it on the tenant. At the hearing, present the evidence of recurrence and seriousness. If QCAT makes a termination order, it issues a warrant of possession, executed by police or a stated authorised person.
Key Legislation: Residential Tenancies and Rooming Accommodation Act 2008 (Qld) - s 246A (retaliatory action may be set aside on the tenant's application), s 297 (objectionable behaviour), s 297B (serious breach), s 335(1) (applications without a notice to leave), s 345 (matters for the tribunal), ss 350-353 (warrant of possession and limits on recovering possession), ss 415-416 (urgent applications). Queensland Civil and Administrative Tribunal Act 2009 (Qld). Bare allegations without documentary support are unlikely to persuade the tribunal; police records and statements from independent witnesses strengthen the application.
