Legal Project Management Plan & Checklist
Defending a Queensland family provision claim as executor: estate evidence, notice to eligible persons and beneficiaries, mediation and trial.
When can an executor safely distribute an estate in Queensland if a family provision claim is possible?: A personal representative who properly distributes not earlier than 6 months after the death without signed written notice of an application or intended application, or, after receiving notice, not earlier than 9 months after the death unless told that proceedings have started or served with them, cannot be sued for the distribution (Succession Act 1981 (Qld) s 44(3) and (4)). Proper distributions for the maintenance of a dependent spouse or child are also protected (s 44(1)).
What does the executor file in response to a family provision application?: The court's sample directions require a personal representative's initial affidavit exhibiting the grant and the will and estimating the estate's assets and liabilities at the death and currently, and require the executor to serve notice of the claim on other eligible persons and on the beneficiaries (Amended Practice Direction 14 of 2023, Appendix A directions 1 to 3).
Executor strategy in a Queensland family provision claim: an active defence or a limited stance, costs exposure and protecting the estate.
Who bears a family provision order in Queensland?: Unless the court directs otherwise, the provision falls rateably on the whole estate, and the court may exonerate part of the estate after hearing those affected (Succession Act 1981 (Qld) s 41(3) and (4)).
Jurisdiction: Supreme Court of Queensland, where family provision applications under s 41 of the Succession Act 1981 (Qld) are managed under Amended Practice Direction 14 of 2023. Forks address the strategic decision the executor must make at the outset: whether to actively defend and oppose the claim, or to adopt a more limited stance and leave the contest to the beneficiaries.
The Process at a Glance: On receiving the application, check it was started within 9 months of the death (s 41(8)), stop distribution, and review the will, the estate inventory and the claimant's relationship with the deceased. Agree directions for the first directions hearing. File the executor's initial affidavit on the estate and serve the claim on other eligible persons and beneficiaries, who may apply to be joined. Consider the merits and the prospects of settlement, attend mediation and, if the claim settles, apply for final orders. If unresolved, prepare for trial with lay and financial affidavit evidence.
Key Legislation and Case Law: Succession Act 1981 (Qld) part 4 - s 40 (definitions), s 41 (family provision; s 41(3) and (4) incidence and exoneration; s 41(8) time limit), s 44 (protection of personal representatives). Uniform Civil Procedure Rules 1999 (Qld) r 31 (applications in a proceeding) and r 661 (filing an order). Amended Practice Direction 14 of 2023 paras 31-42 (family provision applications, including the power to cap costs in smaller estates). Costs are at the court's discretion; an executor who defends reasonably will generally have costs paid from the estate: Sherborne Estate (No 2): Vanvalen v Neaves [2005] NSWSC 1003.

Cease distribution of the estate upon receiving notice and verify the notice was served within the 6-month statutory deadline under s 41(8). If notice was NOT received within 6 months, advise executor of s 44 protection.
Evaluate the originating application against the Singer v Berghouse two-stage test, assess the competing needs of the principal beneficiaries, investigate any disentitling conduct, and determine the strength of the estate's defence.
Draft and file the executor's asset affidavit (Form 46) detailing estate assets, liabilities, and administration costs, plus beneficiary affidavits detailing their financial positions and competing needs.
Issue a Calderbank offer to protect costs position, attend the mandatory mediation under Amended Practice Direction 14 of 2023, and seek an early resolution to protect estate resources.
Brief counsel, compile trial bundle, present the defence at trial, and seek to protect the estate from disproportionate provision orders.
