Purpose of this Guide: Use this fork when a payee client wants to enforce a money order specifically by redirecting commercial, private, or general debts due or accruing to the payer from a third party under Rule 11.36 of the FCFCOA Rules 2021.
Jurisdiction: Federal Circuit and Family Court of Australia (FCFCOA), applying Rule 11.36. National application.
The Process at a Glance: Once a general commercial or private debt owed to the payer is identified, the lawyer drafts the Third Party Debt Notice specifying the commercial debtor. The notice is registered physically. Ordinary service is executed on both the third party and the payer. The third party must pay the attached debt directly to the payee. The lawyer handles any liability disputes filed by the third party.
