Jurisdiction: NSW Local Court, operating under the Crimes (Domestic and Personal Violence) Act 2007 (NSW). This is the defendant-focused pathway for contesting private personal violence orders.
The Process at a Glance: The matter begins with receiving the applicant's Application Notice and verifying service. The practitioner assesses the case for a domestic relationship redirect or debt collection masquerade defense. The practitioner represents the defendant at the First Mention, participating in the CJC mediation referral. If mediation fails and the dispute is contested, the practitioner drafts and exchanges defendant witness statements under the strict Annexure B timetable. After filing the Listing Advice at the Compliance Mention, the practitioner cross-examines the applicant's witnesses at the Contested Hearing and applies for adverse costs.
Key Legislation and Case Law: Crimes (Domestic and Personal Violence) Act 2007 (NSW) - Section 5 (relationship track), Section 19 (statutory fear tests), Section 21 (mediation), Section 99 (costs). Criminal Procedure Act 1986 (NSW) - Chapter 4 costs provisions. Local Court Practice Note - Domestic and Personal Violence Proceedings (4 May 2026) governs statement exchanges.
