Use this fork when the adjoining owner disputes the location of the legal boundary on which the proposed fence is to be constructed. The boundary may be uncertain because boundary pegs are missing, the existing fence is in the wrong location, the property is irregular in shape, or a survey has not been done in many years. A boundary dispute fundamentally undermines the validity of the fencing notice because the proposing owner cannot specify the correct fence line without knowing the boundary.

Jurisdiction: Queensland. The boundary must be determined by a licensed surveyor before a fencing dispute can be resolved. Once the boundary is confirmed, the fencing matter may proceed through QCAT or be resolved by agreement.
The Process at a Glance: The practitioner identifies the boundary dispute issue and advises the client to commission a licensed surveyor immediately. Title searches and historical plans are obtained to support the survey. The surveyor produces a survey plan confirming the legal boundary. The boundary is communicated to the proposing owner. If the proposing owner accepts the survey result, the parties negotiate from the correct baseline. If the proposing owner does not accept the survey result, the boundary dispute may need to be resolved through the court before the fencing matter can proceed.
Key Legislation and Case Law: Neighbourhood Disputes (Dividing Fences and Trees) Act 2011 (QLD) - s18-s22 (contribution framework). Surveyors Act 2003 (QLD) - licensed cadastral surveyor required to identify legal boundaries. Property Law Act 2023 (QLD) - general property boundary provisions (replaced the Property Law Act 1974 (QLD) from 1 August 2025). Note: QCAT can accept a survey as evidence of the correct boundary in fencing proceedings but cannot formally determine the legal title boundary in a genuinely disputed case - that requires a separate court application.

Identify the boundary dispute, commission a licensed cadastral surveyor, and serve a response to the fencing notice raising the boundary dispute as grounds for objection.
