This track guides the practitioner through the process of registering the federal warrant at Titles Queensland to secure title priority and manage the statutory sale.
Jurisdiction: Federal Circuit and Family Court of Australia (FCFCOA), integrated with Titles Queensland under the Queensland Land Title Act 1994. The federal warrant must be registered against the Torrens title to encumber the land and enable sheriff liquidation.
The Process at a Glance: Once the federal warrant is sealed, the lawyer obtains a current Title Search and QVAS search to verify equity. The lawyer drafts a Form 12 Request to Register Writ/Warrant and lodges it in triplicate with Titles Queensland. Once registered, written notice is sent to the Sheriff of Queensland within 7 days. The lawyer secures a kerbside valuation from a registered valuer and directs the Sheriff to sell the land. Under state property law, the sale must occur within 6 months of registration; otherwise the registration lapses and must be renewed.
