The Process at a Glance: The process begins with a review of the current judgment balance including post-judgment interest at 9.60% per annum. Form 65 (Notice of Motion for Writ for Levy of Property) with a supporting affidavit detailing the debt, any payments received, and the known assets is filed through the NSW Online Registry. Form 66 (Writ for Levy of Property) is also prepared. The sealed Writ is lodged with the Sheriff of NSW together with a deposit covering estimated execution costs such as towing and storage. The Sheriff attends the debtor's premises, identifies and tags eligible assets, and arranges for their auction. Proceeds are applied to the judgment debt and enforcement costs, with any surplus returned to the debtor. If personal property is insufficient and the debt exceeds $20,000, the Writ can be registered against the debtor's real property at the Land Registry.
