Legal Project Management Plan & Checklist
Purpose of this Guide: Use this fork when the probate registry has issued a requisition - a formal notice listing deficiencies in the filed application that must be corrected before the grant will issue. Requisitions are common and do not mean the application has been refused; they simply require you to provide additional documents, correct errors, or clarify information.
Jurisdiction: The same Supreme Court registry that issued the requisition - NSW, VIC, or WA.
The Process at a Glance: Read the requisition carefully and identify each item that must be addressed. Gather any additional documents required (corrected affidavit, updated inventory, death certificate if the one filed was insufficient, etc.). Respond in writing to the registry addressing each requisition point. Provide any supplementary affidavit or corrected form. The registry reviews the response and, if satisfied, proceeds to issue the grant. Set a diary reminder if the requisition has a time limit for compliance.
Key Legislation and Case Law: The registry's power to issue requisitions derives from the probate rules of each state - Supreme Court (Probate) Rules 2018 (NSW) Rule 55, Supreme Court (Administration and Probate) Rules 2014 (VIC), Non-Contentious Probate Rules 1967 (WA). Common requisitions relate to: formal defects in the will, insufficient evidence of identity, incomplete estate inventory, or failure to account for all persons named in the will.
