Use this plan when acting for a CTP insurer that has received a Notice of Accident Claim Form (NOAC) in respect of a motor vehicle accident claim in Queensland. This plan covers the insurer's statutory obligations from initial receipt of the NOAC through to claim resolution - whether by pre-court conference settlement or defended trial.
Queensland, Australia. CTP insurers operate under the Motor Accident Insurance Commission (MAIC) regulatory scheme, governed by the Motor Accident Insurance Act 1994 (QLD). Damages are assessed under the Civil Liability Act 2003 (QLD).
Upon receiving a NOAC, the insurer must acknowledge and comply within 14 days (s 41). A liability decision must be made within 6 months (s 41(1)(c)). The insurer reviews the accident circumstances, investigates contributory negligence, and manages rehabilitation funding requests within 10 calendar days under MAIC Rehabilitation Standards. Medico-legal assessments must comply with the MAIC Guideline for Arranging Medico-Legal Assessments. Once the injury stabilises, quantum is assessed using the ISV framework under the Civil Liability Regulation 2025. Both parties attend a compulsory pre-court conference under s 51A. If unresolved, Mandatory Final Offers are exchanged under s 51C - an insurer whose MFO is rejected and who then obtains a judgment less favourable than the claimant's MFO may face indemnity costs. If the matter cannot be settled, defence counsel is briefed for trial in the District or Supreme Court.
