Use this fork when the dispute is about a neighbouring tree causing damage or interference - such as overhanging branches, root damage to foundations or plumbing, leaf litter blocking gutters, or roots undermining a retaining wall. This fork covers disputes under Chapter 3 of the Queensland Act, which operates separately from the dividing fence provisions in Chapter 2. Open this fork when a client first reports tree-related interference from a neighbour's tree.
Queensland. Tree disputes are heard by under Chapter 3 of the Act. The tree provisions do not apply to rural land exceeding 4 hectares, council-owned land, or state-owned land. The tree must be a woody perennial plant, vine, bamboo, or palm as defined under the Act. may appoint a tree assessor (cost up to ,200 shared between parties).
The Process at a Glance: The practitioner documents the damage with photographs and commissions expert reports from an arborist and, if relevant, a structural engineer. For overhanging branches extending more than 50cm past the boundary and no more than 2.5m above ground, a Notice for Removal of Overhanging Branches (Form 3) is served under section 57, giving the tree-keeper 30 days to remove them; if not removed, the affected owner may remove them and recover costs up to per year. For serious root damage or interference beyond the self-help threshold, a QCAT application is filed (Form 51 - tree dispute application, filing fee .40). QCAT must be satisfied the land is affected land within the meaning of the Act - that serious injury, serious damage, or substantial interference with use and enjoyment is occurring or likely within 12 months. QCAT may order removal, lopping, root barriers, compensation, and may override local Vegetation Protection Orders.
