Purpose of this Guide: Use this fork when the ground of challenge is that someone pressured, manipulated, or deceived the deceased into making the will in their favour - for example, an opportunistic carer, a dominant family member, or a new partner who isolated the deceased from their family. Undue influence in the probate context requires proof of actual coercion, not merely persuasion or emotional pressure.

Interview witnesses and gather evidence of dependency, exclusion, financial abuse, and pressure.
The Process at a Glance: Map the deceased's relationships and identify who had access and influence in the final years of life. Obtain financial records showing any unusual gifts or asset transfers. Gather witness statements from family, friends, neighbours, and professionals who observed the deceased's vulnerability and the alleged influencer's conduct. Obtain medical evidence of the deceased's vulnerability to influence. File and serve the evidence. At trial, challenge the circumstances of the will-making and the relationship between the deceased and the beneficiary who allegedly exerted influence.
Key Legislation and Case Law: Undue influence in testamentary proceedings requires proof of coercion that overbore the testator's free will: Hall v Hall (1868) LR 1 P & D 481. Unlike in contract, presumed undue influence does not apply in the testamentary context - actual coercion must be proved. Fraud must be pleaded with particularity. Suspicious circumstances (such as a will made in favour of the drafter) shift the evidentiary burden: Wintle v Nye [1959] 1 WLR 284 (HL). Financial abuse may also ground an application for family provision even if the probate challenge fails.
