Purpose of this Guide: Use this fork when the client is at immediate physical risk and requires a same-day ex-parte interim intervention order from the Magistrates' Court of Victoria. Open it when urgent filing is required to secure safety conditions, such as exclusion conditions, before the respondent is notified or served.
Jurisdiction: Magistrates' Court of Victoria (or Children's Court of Victoria if the applicant is a minor). Governed by sections 53 to 60 of the Family Violence Protection Act 2008 (Vic).
The Process at a Glance: Verify immediate danger indicators and firearms access at intake. Draft the Form FVIO1 Application requesting urgent interim orders along with a Declaration of Truth outlining the immediate danger. Lodge documents directly at the registry counter and request same-day triage by a magistrate. Represent the client in the ex-parte hearing to prove that the interim order is necessary to protect the client or children. Coordinate with Victoria Police to execute personal service of the interim order immediately. Advise the client on the active order and prepare for the return mention hearing.
