Purpose of this Guide: Use this fork when a dividing fence has been damaged or destroyed by a sudden event such as a fallen tree, storm, fire, or vehicle impact and the damage is so severe that immediate repair is necessary to contain livestock, secure a pool, or prevent a genuine safety hazard. In these circumstances, the normal requirement to serve a Form 1 Fencing Notice and wait 30 days is waived under the urgent works exemption.
Jurisdiction: Magistrates' Court of Victoria (Civil Division) for cost recovery after the works are completed.
The Process at a Glance: Photograph and document the damage immediately. Arrange urgent works with a licensed contractor to make the fence secure. Give the adjoining owner as much notice as possible before works begin (even informal telephone notice is better than none). Once works are complete, serve a Form 4 Notice (Urgent Works) on the adjoining owner seeking their 50% contribution. If the neighbour refuses to pay, file a cost recovery application under section 25 in the Magistrates' Court.
Key Legislation and Case Law: Fences Act 1968 (VIC) s 23 (urgent works exemption from pre-action notice) and s 24 (urgent works - pools and livestock). Section 25 provides the cost recovery mechanism after urgent works are completed without prior agreement.
