Legal Project Management Plan & Checklist
Recovering a debt of up to $25,000 through QCAT in Queensland: letter of demand, minor debt claim, response, mediation, hearing and enforcement.
What is the limit for a minor debt claim in QCAT?: $25,000, the prescribed amount for a minor civil dispute. Interest is not counted towards the limit, and a creditor owed more may limit the claim to the prescribed amount by applying to have it dealt with as a minor civil dispute (Queensland Civil and Administrative Tribunal Act 2009 (Qld) ss 11A and 12 and schedule 3).
How long does a respondent have to answer a QCAT minor debt claim?: 28 days after being given a copy of the application, in the approved form with a statement answering the claim (QCAT Rules 2009 (Qld) r 45). A respondent cannot make a counter-application to a minor debt claim (r 48(3)). If no response is filed in time, the applicant may apply for a decision by default, which the principal registrar may make (QCAT Act s 50).
Can legal costs be recovered in a QCAT minor debt claim?: Generally no. Each party bears its own costs (QCAT Act s 100), and in a minor debt claim the tribunal can order only the filing fee, any electronic filing fee, service fees at the prescribed bailiff rates and business name or company search fees (s 102(2); QCAT Rules r 84).
Enforcing a QCAT money order in Queensland by redirecting the debtor's wages or bank funds: financial statement, warrant and service on the third party.
Enforcing a QCAT money order in Queensland by seizure and sale: asset searches, financial statement, enforcement warrant and the enforcement officer.
Getting a QCAT decision by default for an unpaid debt in Queensland: when it is available, what to file and how it can be set aside.
How is a QCAT money order enforced?: By filing a copy of the decision in the registry of a court of competent jurisdiction, after which it is taken to be a money order of that court and may be enforced under UCPR chapter 19 (QCAT Act s 131).
Jurisdiction: Queensland Civil and Administrative Tribunal, minor civil disputes (minor debt claims up to $25,000). Larger claims belong in the courts. Enforcement occurs in the court where the decision is filed, usually the Magistrates Court. Forks cover a decision by default, enforcement by redirection of earnings or debts, and enforcement by seizure and sale.
The Process at a Glance: The process begins with solvency and asset searches, followed by a formal letter of demand giving the debtor a reasonable opportunity to pay. If payment is not received, a Form 3 application for a minor civil dispute (minor debt) is filed with QCAT and a copy given to the respondent. The respondent has 28 days to file a Form 7 response. If no response is filed, a decision by default is available through the dedicated fork. If a response is filed, the tribunal or principal registrar may refer the dispute to mediation (QCAT Act s 75), and notice of the hearing must be given at least 7 days before it (QCAT Rules r 77). The tribunal then makes orders it considers fair and equitable, such as an order to pay a stated amount (QCAT Act s 13), which is enforced through the court in which it is filed.
Key Legislation: Queensland Civil and Administrative Tribunal Act 2009 (Qld) - ss 11, 11A and 12 and schedule 3 (minor civil disputes and the $25,000 prescribed amount), s 13 (orders), s 50 (decision by default), s 51 (setting aside), s 75 (referral to mediation), ss 100 and 102 (costs), s 131 (enforcing monetary decisions), ss 142-143 (appeals and leave). QCAT Rules 2009 (Qld) - r 45 (response to a minor debt claim), r 48 (no counter-application to a minor debt claim), r 60 (application for a decision by default), r 77 (notice of hearing), r 84 (costs in a minor debt claim). Uniform Civil Procedure Rules 1999 (Qld) chapter 19 (enforcement of money orders). Filing fees change; confirm current amounts with the QCAT registry.
