The Four-Step Process

Property settlements under the Family Court Act 1997 follow a four-step process that mirrors the federal approach but applies WA-specific provisions. First, the court identifies and values the existing property pool. Second, it assesses each party's financial and non-financial contributions under section 205ZG(4). Third, it considers future needs factors such as age, health, earning capacity, and care of children. Fourth, it determines whether the proposed order is just and equitable in all the circumstances.

The s.205ZG Factor Analysis

Section 205ZG is the critical provision governing how the Family Court of Western Australia divides property between de facto partners. It requires the court to consider a comprehensive list of factors, including: the financial contribution made directly or indirectly by or on behalf of a party to the acquisition, conservation, or improvement of property; the contribution made by a party to the welfare of the family including any contribution as a homemaker or parent; and the effect of any proposed order on the earning capacity of either party.

Unlike some jurisdictions where contributions are simply tallied up, the WA approach requires a holistic assessment. Non-financial contributions - particularly homemaking and parenting - must be given genuine weight, not treated as secondary to financial contributions. Future Needs Assessment

After assessing contributions, the court considers each party's future needs under section 205ZG(5). Before the court can make a property order, the applicant must establish that the parties were in a de facto relationship as defined by section 13A of the Interpretation Act 1984 (WA).
